Анотація

За сучасних умов становлення демократії в Україні надзвичайно актуалізувалося питання реалізації реального народовладдя, зокрема права на спротив. Дана наукова розвідка – це авторська спроба з’ясувати стан дослідженості права на спротив як форми реалізації народовладдя в Україні. Це дозволить виявити теоретичні прогалини та заповнити їх за допомогою наукового осмислення практики реалізації різних форм народовладдя з метою подальшого нормативного врегулювання та легітимації цих форм.

Дослідження специфіки реалізації права на спротив як форми реального народовладдя через його соціальне призначення дозволить встановити кореляцію між правовою культурою громадян та перспективами демократизації суспільства, де право здатне виступити каналом комунікації між рівнем правової культури суб’єкта реального народовладдя (людини, громадянина, народу) і самим процесом реалізації народовладдям.
